You'd need to place caps on how much spam could be sent, but how do you consistently identify what is called spam? Spam filters might do the trick.

Comcast: Rather than cap bandwidth usage, throttle spammers.
The new bandwidth caps are pretty annoying. I understand that the infrastructure can only take so much, but what about spammers slugging your network with emails?
